Article 1. Seller Identification
The website thekedits.com (hereinafter "the Site") is published and operated by:

Hereinafter referred to as "the Seller".
Article 2. Purpose and Scope
These General Terms and Conditions of Sale (hereinafter "GTC") govern all sales of products concluded between the Seller and any non-commercial individual (hereinafter "the Customer") making a purchase via the Site.
Any order placed on the Site implies the full, complete, and unreserved acceptance of these GTC by the Customer. The Customer acknowledges having read them before validating their order.
The Seller reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the order.
Article 3. Products
The products offered for sale are those listed on the Site, subject to availability. Essential characteristics, prices, and visuals are presented on each product page.
Photographs and illustrations are for illustrative purposes and are not contractual. The Seller strives to present the products as faithfully as possible.
Some products are offered custom-made or personalized according to Customer specifications. These products are identified as such on their page and are subject to specific conditions (see Article 9).
Article 3 bis. Limited Edition Works
3 bis.1 Nature of Works
The products offered are original photographic works within the meaning of Article 98 A of Annex III of the French General Tax Code: photographic prints taken by the artist, printed by her or under her control, signed and numbered by hand, limited to twenty (20) copies per image, all formats and media combined.
3 bis.2 Certificate of Authenticity
Each work is delivered with a certificate of authenticity hand-signed by the artist Mariya Korostelyova, stating: title of the work, dimensions, medium, print number, total print run, date, signature. This certificate serves as proof of the authenticity and originality of the work. Its loss does not entitle to any duplicate; the work remains authentic, but its resale value may be affected.
3 bis.3 Artisanal Character
The works are produced by artisanal processes (printing, mounting on linen, hand-finishing). The Customer acknowledges and accepts that slight variations (grain, shade nuances, micro-irregularities of the textile support) may exist between copies of the same edition. These variations are inherent to the artistic nature of the product and do not constitute a lack of conformity within the meaning of Articles L217-3 et seq. of the French Consumer Code.
3 bis.4 Resale Right (Droit de Suite)
In accordance with Article L122-8 of the French Intellectual Property Code, in the event of resale of a work through an art market professional (gallery, auction house, dealer), the artist or their beneficiaries receive a resale right, the rate and terms of which are fixed by decree. The management of this right is handled by ADAGP (adagp.fr).
3 bis.5 Prohibited Modifications
Any modification, cropping, chromatic alteration, transformation, or derivative use of the work, including by artificial intelligence, is strictly prohibited without prior written agreement from the artist (Art. L121-1 CPI, moral right).
Article 4. Price
Prices are indicated in euros, all taxes included (TTC), including applicable French VAT.
Delivery costs are free throughout the European Union, regardless of the order amount or weight.
The Seller reserves the right to modify its prices at any time, it being understood that the price applicable to the order is that in force at the time of its validation by the Customer.
Article 5. Order
5.1 Order Process
The Customer places an order directly on the Site by selecting the products, adding them to the cart, and then validating the successive steps: identification, delivery address, payment method, order summary, and final validation.
5.2 Verification and Confirmation (the "double click" process)
In accordance with Articles 1127-1 and 1127-2 of the French Civil Code, before the final validation of their order, the Customer is invited to check the details of the order (products, quantities, price, delivery address, payment method) and to correct any possible errors. Order validation is carried out in two stages:
- Detailed order summary, with possibility of modification;
- Confirmation by the Customer implying acceptance of these GTC, the price, and the characteristics of the products.
The order is definitively registered only after this confirmation and after acceptance of payment by the banking service provider. An email confirming the order is sent to the Customer without delay.
5.3 Retention and Archiving of the Contract
In accordance with Article L213-1 of the French Consumer Code, for any order equal to or greater than 120 euros, the Seller archives the contract concluded with the Customer for a period of ten (10) years from delivery. The Customer can access it at any time upon simple request sent by email to communication@mariyakorostelyova.com.
5.4 Order Refusal
The Seller reserves the right to refuse or cancel any order in case of a prior dispute, insufficient stock, clearly erroneous delivery address, or suspicion of fraud.
Article 6. Payment
Payment is made online at the time of order, by the means offered on the Site (bank card, Apple Pay, Google Pay, PayPal, and any other means indicated during payment).
Transactions are secured by payment providers (Shopify Payments, PayPal). The Seller never has access to the Customer's bank details.
The debit occurs at the time of order validation. In case of payment authorization refusal, the order is automatically cancelled.
Article 7. Delivery
7.1 Delivery Area
Products are delivered throughout the European Union.
7.2 Shipping Times
Orders are shipped within 3 to 5 business days from payment confirmation.
In case of exceptional unavailability or unforeseen extension of the deadline, the Customer is informed by email within 48 hours, with a proposal for a new deadline or immediate refund. In accordance with Article L216-1 of the French Consumer Code, failing shipment within a maximum period of 30 days, the Customer may terminate the contract and obtain a full refund within 14 days.
7.3 Delivery Methods
Delivery is made by carrier, with mandatory signature upon receipt. The Customer must be present at the indicated address or designate an authorized third party to sign.
In case of absence, a delivery notice is left, and the package can be picked up at a relay point or rescheduled for a new delivery, depending on the carrier's terms.
7.4 Verification upon Receipt
The Customer is invited to check the condition of the package upon delivery. In case of damage or missing items, they must make precise and detailed reservations on the carrier's delivery slip and inform the Seller by email within 3 business days.
Article 8. Right of Withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to give any reason or pay any penalty.
8.1 Exercise Modalities
To exercise their right of withdrawal, the Customer notifies their decision to the Seller by email at communication@mariyakorostelyova.com, using an unambiguous statement or via the standard form below:

8.2 Product Return
The Customer returns the product, in its original packaging, in perfect condition, to the following address:

The return must take place no later than 14 days after the notification of withdrawal.
Return costs are the sole responsibility of the Customer.
It is recommended to return the product by tracked and insured mail. The Seller cannot be held responsible for the loss or damage of the package during return.
8.3 Refund
The Seller will refund the full amount paid (product price), no later than 14 days after receipt of the returned product or proof of shipment, using the same payment method as used during the order.
Article 9. Personalized or Custom-made Products
In accordance with Article L221-28, 3° of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the Customer's specifications or clearly personalized.
Products identified as "custom-made" or "personalized" on their product page are final upon order validation. No return, exchange, or refund is possible, except for non-conformity or hidden defects (see Article 10).
Article 10. Legal Guarantees
The products sold benefit from the legal guarantees provided by French law, independently of any commercial guarantee:
10.1 Mandatory Information Box
In accordance with Article L211-2 and Decree No. 2022-946 of June 29, 2022:
LEGAL GUARANTEE OF CONFORMITY
The consumer has a period of 2 years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a defect in conformity. During this period, the consumer is only required to establish the existence of the defect in conformity and not the date of its appearance.
The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all necessary updates to maintain the conformity of the goods.
The legal guarantee of conformity gives the consumer the right to repair or replace the goods within 30 days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a 6-month extension of the initial guarantee.
If the consumer requests the repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of 2 years from the date of replacement of the goods.
The consumer can obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund against return of the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods occurs after a period of 30 days;
3° The repair or replacement of the goods causes a major inconvenience to the consumer, particularly when the consumer permanently bears the costs of recovery or removal of the non-conforming goods, or if they bear the costs of installation of the repaired or replacement goods;
4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer also has the right to a reduction in the price of the goods or to the termination of the contract when the defect of conformity is so serious that it justifies the price reduction or the termination of the contract immediately. The consumer is then not obliged to request the repair or replacement of the goods beforehand.
The consumer does not have the right to terminate the sale if the defect in conformity is minor.
Any period of immobilization of the goods for their repair or replacement suspends the guarantee that remained to run until the delivery of the repaired goods.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
The seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity incurs a civil fine of a maximum of 300,000 euros, which can be increased to 10% of the average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles them to a price reduction if the goods are kept or a full refund against return of the goods.
10.2 Legal Guarantee of Conformity
Articles L217-3 et seq. of the French Consumer Code. The Customer has 2 years from delivery of the product to act. They can choose between repair or replacement of the product, free of charge. If these solutions are impossible or disproportionate, the Customer can obtain a price reduction or termination of the sale.
10.3 Guarantee Against Hidden Defects
Articles 1641 et seq. of the French Civil Code. The Customer can act within a period of 2 years from the discovery of the defect and obtain a refund or price reduction.
10.4 Implementation
Any request under the legal guarantees must be sent by email to communication@mariyakorostelyova.com with a precise description of the defect and supporting photographs. The Seller undertakes to provide an initial response within 5 business days.
Article 11. Liability
The Seller cannot be held responsible for the non-performance of the contract in cases of force majeure, disruption or total or partial strike of postal and transport services, or natural disaster.
The Seller's liability can in no case exceed the amount of the order concerned.
Article 12. Personal Data
Personal data collected is processed in accordance with the General Data Protection Regulation (GDPR) and the amended French Data Protection Act.
- Data Controller: Mariya Korostelyova
- Purposes: order management, delivery, invoicing, customer service, marketing communications (subject to consent).
- Retention Period: 3 years after the last order for customer data, 10 years for accounting documents.
- Recipients: Seller, technical service providers (Shopify, carriers, payment providers), administrations in case of legal obligation.
The Customer has a right to access, rectify, erase, data portability, restrict processing, and object to the processing of their data, exercisable by email at communication@mariyakorostelyova.com.
In case of an unresolved dispute, the Customer can file a complaint with the CNIL (cnil.fr).
Article 13. Intellectual Property
All elements of the Site (texts, visuals, logos, brands, photographs) are protected by copyright and trademark law. Any reproduction, representation, modification, or exploitation, total or partial, without prior written authorization from the Seller is strictly prohibited.
Article 13 bis. Packaging and Waste Sorting
In accordance with Article L541-9-3 of the French Environmental Code and Decree No. 2021-835 of June 29, 2021 ("Info-tri"), the packaging of products delivered by the Seller bears the Triman and Info-tri sorting symbols.
The Seller is a member of the eco-organization CITEO under the REP household packaging scheme.
The Customer is invited to comply with the sorting instructions on the packaging to allow for their recovery.
Article 14. Consumer Mediation
In accordance with Articles L611-1 et seq. of the French Consumer Code, in the event of an amicably unresolved dispute, the Customer may use a consumer mediator free of charge.
The Seller has joined the mediation service:

Prior to any referral, the Customer must have attempted to resolve the dispute directly with the Seller through a written complaint.
In accordance with Regulation (EU) No 524/2013, the European Commission also provides an Online Dispute Resolution (ODR) platform accessible at: ec.europa.eu/consumers/odr.
Article 15 bis. Sales at Fairs, Exhibitions or Stands (physical sales)
15 bis.1 Scope
This article governs sales concluded in person between the Seller and the Customer at a fair, exhibition or stand, particularly at the Côté Sud exhibition in Aix-en-Provence. These sales do not constitute distance sales within the meaning of Article L221-1 of the French Consumer Code. In the event of a contradiction with the other articles of these GTC, this article shall prevail for physical sales only.
15 bis.2 Absence of right of withdrawal
In accordance with Article L224-59 of the French Consumer Code, the Customer is informed that, for any purchase made at a fair, exhibition or stand, there is no right of withdrawal. This absence of a right of withdrawal applies whether the artwork is handed over to the Customer immediately or shipped at a later date (see 15 bis.4). This information is indicated by a visible display on the stand and by a mention on the order form or sales receipt given to the Customer.
15 bis.3 Sale with immediate delivery
When the artwork is available on the stand, it is handed over to the Customer immediately upon payment. A sales receipt (invoice) is given to the Customer. Payment is made by the means offered on the stand (bank card, and any other indicated means).
15 bis.4 Sale with deferred shipment (artwork out of stock)
When the ordered artwork is no longer available on the stand, the Customer may nevertheless order and pay for it on site. The Seller then provides the Customer with a written order form specifying the artwork, the price paid, the delivery address and the shipping time. The artwork is shipped within 7 working days from the close of the exhibition, according to the terms of Article 7 of these GTC (free delivery in the European Union, delivery with mandatory signature). The absence of a right of withdrawal provided for in 15 bis.2 also applies to this sale, as the order was concluded on the stand.
15 bis.5 Legal guarantees
Physical sales benefit from the same legal guarantees as online sales: legal guarantee of conformity (2 years) and guarantee against hidden defects (2 years), under the conditions of Article 10. The authenticity, numbering and signed certificate provided for in Article 3 bis apply identically.
15 bis.6 Custom or personalized artworks
The conditions of Article 9 remain applicable to custom or personalized artworks sold at exhibitions.
Article 15. Applicable law and competent jurisdiction
These GTC are governed by French law.
In the event of a dispute, and after the failure of any attempt at amicable resolution and mediation, the competent court will be determined according to the rules of the Code of Civil Procedure applicable to the consumer Customer (notably articles R631-3 et seq. of the French Consumer Code).
